Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Sebo Massage’s website at
sebomassageandspa.com, the application at
app.sebomassageandspa.com, and the Sebo Massage
mobile applications (collectively, the “Service”). By using the Service you agree to these Terms.
If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old, or of the age of majority in your jurisdiction, to use the
Service. Spa-partner accounts may only be created by a person authorized to bind the partner to
these Terms.
2. Accounts
- You are responsible for keeping your password secure and confidential.
- You are responsible for activity under your account, including any actions taken by people you
allow to use it.
- You will notify us immediately at
info@sebomassageandspa.com if you suspect any
unauthorized access.
- We may suspend or terminate any account that violates these Terms or that we reasonably
believe presents a security or trust risk.
3. Bookings, cancellations, and refunds
- The Service connects customers with independent spa businesses ("Branches") operating on the
Sebo Massage platform. Each Branch is solely responsible for the services it delivers and
for compliance with applicable health and safety regulations.
- Some Branches require an advance deposit or full advance payment to confirm a booking. The
amount, time-band rates, and any add-ons are displayed and re-confirmed before you complete a
booking. The server-resolved price shown at confirmation is the amount you will be charged.
- Cancellation: you may cancel a booking from the app at any time up to the
cancellation window configured by the Branch (default 24 hours before your scheduled session
unless the Branch publishes a different window in its profile). Cancellations within the
window may not be eligible for a deposit refund.
- No-show: if you do not arrive within the grace period configured by the
Branch (typically 15 minutes), the Service automatically marks your booking as No Show.
Deposit forfeiture for no-shows is at the Branch's discretion under its published policy.
- Refunds: refund decisions on advance deposits sit with the Branch, since it
is the party providing the service. Sebo Massage will assist in mediation if you and the
Branch cannot agree — contact us at the address in section 13.
- We do not store full payment-card details. Payment via GCash or cash is settled between you
and the Branch through the channels displayed in the Branch profile.
4. Acceptable use
You agree not to:
- Use the Service to harass, threaten, or endanger any person.
- Attempt to gain unauthorized access to any account, system, or data.
- Scrape, crawl, or otherwise systematically extract data from the Service without our written
permission.
- Reverse engineer, decompile, or attempt to derive source code from the Service except as
permitted by applicable law.
- Use the Service to send spam, unsolicited bulk messages, or to interfere with other users'
access.
- Upload content that infringes intellectual property, violates privacy, or is unlawful.
5. Spa-partner subscriptions
If you operate or manage a spa Branch on Sebo Massage, the following additional terms apply to your
subscription:
- Free trial: new Branches begin on a 7-day free trial from
the moment the Branch is created. No payment is required to start the trial; the Branch is
fully operational for the trial period.
- Renewal: at the end of the trial, the subscription must be renewed for the
Branch to continue accepting bookings. Renewal is initiated by the Branch owner from inside the
Shopowner app or by contacting us.
- Billing cycle: subscriptions are billed in advance for the period selected
(monthly, quarterly, or annually). Each renewal extends the active period from the previous
paid-through date.
- Lapse: if a subscription is not renewed before its end date, the Branch
enters a past due state and new customer-facing bookings are paused. Existing
confirmed bookings remain unaffected. Renewal restores normal operation immediately.
- Refunds on partner subscriptions: subscription fees are generally
non-refundable once the billing period has begun, except where required by applicable law
or in cases of platform unavailability we materially failed to remedy. Pro-rata refunds may be
granted at our discretion in extraordinary circumstances.
- Cancellation: a Branch owner may cancel a subscription at any time from inside
the Shopowner app. Cancellation takes effect at the end of the current paid period.
- Disputes between Branch and customer: in case of a customer dispute, Sebo
Massage will facilitate communication but is not a party to the underlying service contract
between the Branch and the customer.
6. Notifications and communications
- Transactional: by creating an account, you agree to receive booking-related
emails and push notifications (confirmations, reminders, status changes, security alerts).
These are an essential part of the Service and cannot be opted out of without closing your
account.
- Marketing: we do not send marketing or promotional messages without a
separate, explicit opt-in. You can withdraw consent for marketing at any time without
affecting transactional messages.
- Push notifications: you can disable push notifications in your device's
settings or by signing out of the mobile app.
7. Intellectual property
All trademarks, logos, copy, and software comprising the Service are owned by Sebo Massage or its
licensors. These Terms do not transfer any ownership rights to you. You retain ownership of content
you submit; you grant us a non-exclusive, worldwide, royalty-free license to host, transmit, and
display that content as necessary to operate the Service.
8. Third-party services
The Service integrates with third-party services, including Google Calendar (if you choose to
connect it), Firebase Cloud Messaging (for push notifications on the mobile apps), Titan Email
(for outbound notifications), and the GCash payment channel. Those services are governed by
their own terms; we are not responsible for their availability or content.
9. Disclaimers
The Service is provided "as is" and "as available." To the maximum extent permitted by Philippine
law, we disclaim all warranties, express or implied, including fitness for a particular purpose
and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or
free of viruses or other harmful components.
10. Limitation of liability
To the maximum extent permitted by law, in no event will Sebo Massage, its affiliates, or its
suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, or
any loss of profits or revenues, whether incurred directly or indirectly, arising out of your
access to or use of the Service. Our aggregate liability for any claim relating to the Service is
limited to the amount you have paid us in the twelve (12) months preceding the claim.
11. Indemnity
You agree to defend, indemnify, and hold harmless Sebo Massage from any claim, demand, loss, or
damages, including reasonable attorneys' fees, arising out of your use of the Service in
violation of these Terms or of applicable law.
12. Termination and account deletion
You may stop using the Service at any time. You can request deletion of your account and personal
data by following the procedure in section 7 of our
Privacy Policy. We respond to verified deletion requests
within 30 days.
We may suspend or terminate your access if you violate these Terms or if we believe doing so is
necessary to protect the Service, our users, or third parties. Sections that by their nature
should survive termination (e.g. ownership, disclaimers, limitation of liability, dispute
resolution) will survive.
13. Changes to these Terms
We may change these Terms from time to time. If changes are material, we will provide notice by
email or an in-app banner before the change takes effect. Continued use after the effective date
constitutes acceptance.
14. Dispute resolution and governing law
If you have a dispute with us, first contact
info@sebomassageandspa.com and give us at least
30 days to attempt a resolution in good faith. If the dispute remains unresolved
after that period, either party may pursue formal action.
These Terms are governed by the laws of the Republic of the Philippines, without regard to its
conflict-of-laws rules. The courts of Metro Manila, Philippines have exclusive jurisdiction over
any dispute arising out of these Terms or the Service, except that either party may seek
injunctive relief in any court of competent jurisdiction.
